Terms of service.

Introduction

These terms of service apply between you, the user and biwu, the owner and operator of this website and its services. This page is here to protect you, the user, and to give you information about biwu and the terms on which we provide our services to you. Please read these terms carefully, as they affect your legal rights. By using our services, you automatically agree to the policies laid out within. If you do not agree with these policies you should not proceed with using biwu.

The following terminology applies to these Terms and Agreements: "User”, "You" and "Your" refers to you, the person using this website and compliant to biwu’s terms of service. "biwu", "We", "Our" and "Us", refers to the Company. "Party", "Parties", or "Us", refers to both the User and biwu. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

General

Biwu is a small company and we will do our best to get back to every User as soon as possible. You may contact us by e-mailing us at info@biwu.co.uk. If we have provided the user with a direct contact number we have done so with discretion and may request that future contact to them via that number be stopped.

In order to enter into a contract with biwu you must be a business owner or have permission to do so by the business owner, and by entering into a contract you are agreeing to this being the case.

Tailored pricing for services are to be provided by biwu and are defined in the quotation that the user receives via e-mail. Quotations are valid for a period of 60 days. Biwu reserves the right to alter or decline to provide another quotation after this time.

Whilst we will always work towards the satisfaction of our users, designs are subjective and as such we cannot guarantee the success of the user’s services.

  

Agreements

Biwu is a managed service and as such we hold complete ownership of the websites and services that we design, provide and manage. We are not obligated to provide full breakdown costs of our services.

The user understands that we source high quality third party templates to provide you with the best possible service. As such the user acknowledges that we may be restrained by the core functionalities of such platforms.

We will host your website on third party servers. By agreeing to this you acknowledge that hosting systems have the potential to be down as a result of outside factors such as maintenance or software upgrades. Our services are designed to offer our clients convenience and whilst we will always use the highest quality providers downtime is outside of the control of biwu.

Once a contract has been agreed, we do not offer refunds of services and we do not compensate for any potential loss of earnings outside of our reasonable control. Outside of the stated contract length we have no notice period. However, in the event of cancellation we reserve the right to remove the website.

During our design process, biwu will require the user to provide website content, without this content we will not be able to complete the website.

The user guarantees that all elements of text and images provided for use are either owned by use, or that the user has license/permission to use them.

Our ‘unlimited edits’ feature is as per our content management solution. The user will be provided with content forms which are to be updated by the user, the use and management of this form is the responsibility of the user. Biwu will make every endeavour to update site content as soon as possible.

Biwu reserves the right to use design credit, in the form of a small link in the footer of the user’s website. The link would be tailored to the design of the website and be unobtrusive, but should the user wish to remove it from their site they may do so for a small agreed upon fee.

 

Payments

Payment for any service will be due by bank transfer and direct debit, the terms of which will be set out in the contract confirmation email. Invoices will be provided by biwu, via e-mail.

The payments for any additional expenses required by the user, such as licensed fonts or plugins, would be required prior to the purchase of the required materials and invoiced as such.

Failure to complete payment on agreed dates or the removal of payment methods without notice will be treated as a breach of your contract and could result in a suspension of service, administration charges and the removal of your site.

We reserve the right to adjust the charges at any time if the cost to us in providing products or services to you increases but any such changes would not be made without pre-warning.

 

Cancellation

Cancellation of services by the user must be requested by email. Whilst there is no notice period there will be no refunds for any service already paid, the user should therefore inform biwu in advance of the next scheduled payment.

Upon cancellation biwu reserves the right to remove public access to the website and its domain.

 

Liability

Biwu, and anyone involved in the services provided, will not be held liable for any losses beyond reasonable control. Biwu excludes itself from losses caused by inaccuracy, omissions or delays. Such loses may include, but are not limited to; profits, income, revenue, savings, goodwill or commercial opportunities. The entire liability of biwu to the user, given any breach of these terms, shall be limited to the costs paid for its services.

These terms and agreements shall be governed by and interpreted according to the laws of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.
